Probate

Probate is the process of applying at Her Majesty’s Courts Service (HMCS), via the Probate Registry, for either a Grant of Probate (where there is a will to execute) or for Letters of Administration (where a person has died intestate, without a will).

In either case, the result is legal document known as a Grant, which gives the holder (the Personal Representative, or Executor or Administrator) the authority and power to release assets from the various financial institutions and to deal in any property owned by the deceased.

We can offer a fixed price probate service, whereby we would attend to the preparation of the necessary application to the Probate Registry, and we could ‘extract the Grant’ on your behalf. Once the Grant is obtained, you yourself could attend to the dealings wth Banks and other financial institutions in releasing funds. This would save you considerable costs, compared with using a traditional high street solicitor who would typically charge an hourly rate plus levy a further fee based upon a percentage of the estate in question (of 1% to 1.5%). Of course, once you hold the Grant, we would be happy to assist furher in securing the release of assets from the various institutions, and in the sale of any property. The final stage is the distribution of the estate assets to the beneficiaries under the Will (or Intestacy) of the deceased.
